Lawyers Assisting In The Business Formation Process

It is not uncommon for individuals to come to us regarding business formation. Entity selection — sole, partnership, LLC or corporation — is an important decision that must be made early in the organizational process. We can guide a client through these types of decisions as well as drafting bylaws and determining a business succession plan. Schedule a consultation today to discuss your new business.

Helping Creditors Collect What Is Due

We represent creditors both inside and outside of the bankruptcy context. Outside of bankruptcy, we assist creditors who desire to collect a debt they are owed by securing a judgment in circuit courts, perfecting and enforcing liens on the debtor’s real estate, executing on the debtor’s personal property, garnishing a debtor’s wages or bank accounts, and setting aside and avoiding fraudulent conveyances made by debtors.

We also represent creditors who are owed a debt by a person or business that have filed for bankruptcy protection under Chapter 7, 11, 12 or 13 of the Bankruptcy Code. Our services include assisting creditors who believe their debt is nondischargeable because of fraud committed by the debtor or for some other reason and defending creditors who are alleged to have received preference payments from the debtor 90 days prior to filing bankruptcy. We handle proof of claim and asset valuation disputes, and help creditors seek relief from the automatic stay in bankruptcy.
